NO PURCHASE NECESSARY TO ENTER, WIN OR CLAIM THE PRIZE. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING.  

Welcome to the Fremont Brewing Ski Slope Sweepstakes (“Sweepstakes”). The Sweepstakes are sponsored and administered by Fremont Brewing, Seattle, WA, LLC, located at 4700 9th Ave W, Seattle, WA 98107 (“we,” us,” or “Sponsor”).  

Please read these official rules (the “Rules”) carefully as they are a legally binding agreement between any person who enters the sweepstakes (“you” or “entrant”) which affects some of your legal rights, including your right to sue us. If you do not agree to the Rules without change, please don’t enter the Sweepstakes.

ELIGIBILITY   

  • This Sweepstakes is available only to legal residents of the following U.S. states who are at least 21 years old at the time they enter: Washington (WA).   

  • Our employees, directors, officers, agents, and those of our parent companies, divisions, dealers, affiliates, subsidiaries, advertising and promotional agencies (“Sweepstakes Entities”), as well as the members of each of their immediate families (spouse, parents, children, siblings, and in-laws) and persons residing in the same household as such individuals are not eligible to enter or win. In addition, the employees, agents and officers of alcohol beverage retailers and distributors and their immediate family members are not eligible to enter or win.   

  • The Sweepstakes are void where prohibited or restricted by law.   

WHEN TO ENTER  

The Sweepstakes begins at 12:00 PM Pacific Standard Time on December 1, 2024 and ends at 11:59:59 PM Pacific Standard Time on February 28, 2025 (the “Sweepstakes Period”). Our computer is the Sweepstakes official clock.  

HOW TO ENTER  

  • During the Sweepstakes Period, logon to www.fremontbrewing.com (the “Website”). You’ll be asked to submit your date of birth and ZIP Code and provide additional information to enter, which may include your first and last name (initials are not permitted), valid e-mail address, complete mailing address (P.O. Boxes are not permitted), telephone number and affirmation that you have read and agrees to be bound by these Official Rules. That’s it! Once you complete and submit the form by clicking “submit” or following any instructions on the Website about how to submit your entry, you’ll be entered into the Sweepstakes.  

  • Limit one entry per entrant.  If we receive more than one entry from the same person, we’ll only consider the first entry and the remainder will be invalid.  

  • All entries become our property.   

PERSONAL INFORMATION  

As you saw, we will collect certain information about you as part of the entry process and we’ll also collect information as part of the prize awarding and redemption process, as discussed below (“Sweepstakes Information”), including information that can be used to identify you, such as your first and last name, email address and, for potential Winners, your physical address (“Personal Information”). By participating in this Sweepstakes, you grant us the right to: (a) use all Sweepstakes Information for the purpose of operating and administering the Sweepstakes; (b) as otherwise permitted by our Privacy Policy. Also, if you are selected as a Winner, we may disclose your first initial, last name and city and state of residence to third-parties who requests that we provide them with a Winner list. We will not provide your Personal Information to any third party other than (i) as provided for in these Rules; and (ii) to our contractors and business partners who may assist us for the business purposes described in (a) but only to the extent required for them to do so.  We will otherwise treat all Personal Information as required by applicable laws and in accordance with our Privacy Policy, which is incorporated into these Rules and is part of the binding agreement between you and us.  

HOW TO WIN  

  • We will select one potential winner on or around the first day of December, January, and February at random via a computerized process from all eligible entries received during the Sweepstakes Period. Upon fulfillment of the criteria set forth in these Rules (and in particular those set forth in this section), we will confirm the potential winner as the actual prize winner (“Winner”). We do not guarantee that any individual entrant will become the Winner.  

  • We will notify the potential winner by email or phone at the email address or telephone number provided in his or her entry. The potential winner may also be required to execute an affidavit attesting to his or her eligibility to be confirmed as a Winner and an additional legally binding release (all such documents, the “Additional Documents”) The Additional Documents must be signed and returned by the date we indicated in the communication with which they are provided or the potential winner will be disqualified.  

  • If a potential winner cannot be contacted by the information provided in his or her entry, fails to sign and return the Additional Documents within the required time period (as applicable) or the potential winner is otherwise disqualified as permitted in these Rules, the potential winner forfeits the prize.   

  • Receiving the prize is contingent upon compliance with these Rules. If a potential winner is disqualified for any reason, an alternate winner will be selected in a random drawing from among all remaining eligible entries in the manner set forth above.  The prize may remain unawarded if we are required to conduct more than three alternate drawing.   

  • Your odds of winning the prize depend on the total number of valid entries we receive.  

  • If there is a dispute as to the identity of the Winner, the winning entry will be declared made by the authorized account holder (as indicated by the applicable ISP, OSP or other organization) of the email address submitted on the registration form associated with such entry. We may require a potential winner to show proof that he or she is the authorized account holder for the applicable email address.  

THE PRIZE; HOW TO CLAIM IT; OTHER PRIZE TERMS AND CONDITIONS 

  • The prize is two (2) tickets to a Washington Ski Slope of their choice: Whites Pass, Crystal Mountain, Stevens Pass, Mt Spokane, Summit at Snoqualmie.  

  • Once we verify the Winner, we will ship the prize to the physical address the Winner provided us at the time of entry. We will pay all postage/delivery costs, except for any tax liability as discussed below. We are not responsible and will not attempt to redeliver the prize if our mailing is returned as undeliverable nor for any damage to or loss of the prize (or its components) occurring after they are delivered to the Winner. If the Prize is returned as undeliverable or we are otherwise not able to deliver it to the address the Winner provides, the Winner will forfeit the Prize and we will select an alternate Winner by the method set forth above.  

  • If the prize is forfeited for any reason, we may award it to an alternate Winner, in our discretion, selected at random by the process set forth above. 

  • For clarity, the prize only includes the items specifically listed in these Rules and may not be redeemed for cash nor any substitutions permitted, unless we agree in our sole discretion. The Winner’s right to receive the prize may not be transferred.   

  • If we can’t award the prize for any reason, we reserve the right to substitute another prize of equal or greater value.   

TAXES AND OTHER EXPENSES  

  • Federal, state, and local taxes on the prize relating to the acceptance of and use of the prize not specified in these Rules are the Winner’s responsibility. We will issue an IRS Form 1099-MISC to the Winner for the ARV of the prize at the time we awarded it.  

  • All other costs and expenses not expressly set forth in these Rules that the Winner may incur in connection with these Sweepstakes are the Winner’s sole responsibility.             

Please read the remaining sections carefully as they affect your legal rights, including your right to sue.  

ASSUMPTION OF RISK; WAIVER AND RELEASE; INDEMNITY  

  • Assumption of Risk; Waiver and Release of Liability.  

  • You acknowledge and agree that your participation in the Sweepstakes and, if applicable, your redemption of the prize, is undertaken voluntarily and entirely at your own risk and you agree to assume all such risk, including risk of property damage, bodily injury or death, and all other damage or potential damage, whether known or unknown to you.   

  • Without limiting your obligations in the next paragraph, you agree to release the Sweepstakes Entities from, and forever give up and waive your right to sue or claim against any of them for, any and all claims, causes, suits or other liability, loss, harm, damages, costs or expenses, whether known or unknown to you, arising out of, caused by, resulting from or relating to this Sweepstakes, these Rules, your participation in the Sweepstakes and/or your use or misuse of the prize, including without limitation property damages, personal injury and/or death, defamation or invasion of privacy and merchandise delivery. Please note that this waiver and release specifically extends to Claims or portions of Claims alleging or arising as the result of Sweepstakes Entities’ negligence.  

  • You acknowledge and agree that the foregoing waiver and release will be binding on your heirs, estate, successors and assigns.   

  • Indemnity. You agree to indemnify, defend and hold harmless the Sweepstakes Entities from and against any and all Claims brought by third-parties against one or more of the Sweepstakes Entities and/or suffered or incurred by one or more Sweepstakes Entities as a result of such third-party Claims to the extent arising out of or relating to your violation of these Rules including, without limitation, your breach of the rules set forth above.  

LIMITING OUR LIABILITY TO YOU; LIMITATION OF LIABILITY IN GENERAL 

  • Without limiting your waiver and release of Claims above, you acknowledge and agree that we assume no responsibility or liability for any of the following: lost, late, incomplete, inaccurate, stolen, misdirected, illegible, corrupted or altered entries, any error, omission, interruption, deletion, defect, or delay in operation or transmission of entries, any communications line failure, theft or destruction of or unauthorized access to entries, alteration of entries, technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any entries to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrants’ or any other persons' computers or smart phone devices related to or resulting from participation or downloading any materials in this Sweepstakes.  

  • To the maximum extent permitted by applicable laws, neither you nor we will be entitled to recover any special, consequential, punitive, statutory or other indirect damages in connection with these Rules or these Sweepstakes, regardless of the legal theory under which such damages might be awarded. In other words, recovery for any disputes under these Rules will be limited to direct damages only.   

ADDITIONAL TERMS  

  • General Conditions.  We reserve the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond our reasonable control impairs the integrity or proper functioning of the Sweepstakes, or for any other reason, as determined by us in our sole discretion.  We, in our sole discretion, reserve the right to disqualify any Entrant we determine to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of the Rules of this or any other promotion or in an unsportsmanlike or disruptive manner.  Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, we reserve the right to seek damages from any such person to the fullest extent permitted by law.  Our failure to enforce any term of these Rules will not constitute a waiver of that provision or any other provision of them.  

  • No Warranty. Without limiting the foregoing, everything regarding this Sweepstakes, including the prize, is provided “as is” without warranty of any kind from us either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement.   

  • Disputes; Agreement to Arbitrate; Class Action Waiver. By entering this Sweepstakes, you agree to these Rules and our decisions about and interpretation of and in connection with them, all of which are final and binding in all respects. This Sweepstakes and these Rules are governed by the laws of the State of Washington, without regard to its conflicts of laws principles. You agree that any disputes arising out of or relating to these Sweepstakes will be finally resolved by binding arbitration conducted by a single arbitrator administered by the American Arbitration Association in accordance with its rules. Arbitration will be conducted in King County, WA. You agree that your and our obligations and rights and any disputes regarding them will be resolved individually, without resort to any form of class action. 

WINNER LIST  

To obtain the name of the Winner, mail a self-addressed, stamped business-sized envelope to: Fremont Brewing Ski Slope Sweepstakes - Winner List Request, 4700 9th Ave W, Seattle, WA 98107. Winner List requests must be received by March 31, 2025.
